These Terms set out the parties’ rights and obligations in connection with the sale of the Products on this Website, and only on this Website.
ARTICLE 1 – IDENTIFICATION OF THE SELLER
My Bitcoin Academy is a brand name of David da Silva Rosa, whose registered office is located in Villanueva de la Vera, 10470 Cáceres, Spain, and registered in the Economic Activities Register of the Spanish Tax Agency (Agencia Tributaria, AEAT) with tax identification number NIF: Z2072606N.
ARTICLE 2 – TERMS
To make these general terms of sale easier to read and understand, we have provided definitions for some important concepts. In this document, the first letter of each word of a defined term is capitalized:
“Terms”: this document (our general terms and conditions of sale), which applies to purchases of Products that you make from My Bitcoin Academy as a Customer of the Website.
“Customer”: an end customer (user of the Product) who places an order on the Website with My Bitcoin Academy. A Customer must have the capacity to enter into an electronic distance-selling agreement with My Bitcoin Academy. End customers may purchase the Products for business or non-business purposes but may not purchase them for resale.
“Website”: My Bitcoin Academy’s e-commerce website at www.mybitcoin.academy.
“Seller”: My Bitcoin Academy, a brand name of David da Silva Rosa as designated in Article 1 above that sells you the Products you purchase on the Website.
“Product”: the Products offered for sale on the Website, including but not limited to online courses and video consultation calls.
“Course”: A type of Product sold on the Website enabling the Customer to access and use the online information contained within the Course.
“Materials”: The information included in an online Course including but not limited to documents, video, and audio developed by us, and other materials which may assist in your participation in the Course.
ARTICLE 3 – ORDERS
To order Products on this Website, you must be at least eighteen (18) years of age and have the legal capacity to enter into contracts. If you place an order on behalf of a company or another legal entity, you confirm that you have the authority to act on behalf of this entity and that this entity accepts the Terms.
It is your responsibility to determine and select the Products appropriate to your needs and then follow the order process on the Website.

Once you’ve found the Product you’d like, you complete your purchase by following the instructions provided at each step, then check the order summary is accurate before clicking on the “Place Order” button.
A confirmation email will then be sent to you. You will also receive an invoice.
ARTICLE 4 – PRICES
The prices invoiced for the Products are the prices displayed on the Website’s payment page once you confirm your order, after having checked it and modified it if necessary.
My Bitcoin Academy reserves the right to change the price of the Products displayed on the Website at any time without notice before a purchase is made.
Our prices are provided to you after tax. All services provided are subject to Spanish VAT at the standard rate of 21%.
For VAT-registered clients in other EU countries, no Spanish VAT will be charged, provided a valid EU VAT number is provided. The reverse charge mechanism will apply as per EU VAT Directive 2006/112/EC.
Services provided to clients outside the EU are exempt from Spanish VAT, subject to verification of the client’s tax status.
All invoices will detail the taxable base, the applicable VAT rate, and the total VAT amount in compliance with Spanish invoicing regulations.
ARTICLE 5 – RETENTION OF TITLE AND PAYMENT
The total amount is invoiced at the time of the order. Payment is made at the time of the order prior to delivery of the Product.
Payment is made using one of the payment methods accepted by My Bitcoin Academy.
My Bitcoin Academy retains ownership of each Product delivered until My Bitcoin Academy receives full payment of the amount due for said Product. In the event of non-payment or irregular payment, My Bitcoin Academy reserves the right, after registration, to suspend or cancel the order and/or delivery.
ARTICLE 6 – LICENSE TO ACCESS AND USE COURSE MATERIALS
After the purchase of an online Course, you will receive an email with instructions to access the course Materials.
Subject to these Terms, we grant you a non-exclusive, limited, non-transferable, and revocable license to use the Materials solely in connection with your participation in the Course and your use of the Website. The Materials may not be used for any other purpose, and this license terminates upon expiry of the access period described in Article 7, your cessation of use of the Course or the Website, or at the termination of this Agreement.
The Course and any of its accompanying Materials may not be shared with any other party. If we suspect that the Course or Materials are being shared and/or that you have shared your log-in information with any party, we reserve the right to immediately terminate your access to the Course, in our sole and exclusive discretion.
ARTICLE 7 – ACCESS PERIOD
After purchasing the Course, your access to the Materials will expire 6 months after the moment you receive access.
After completing the Course, you may receive a certificate evidencing your participation in, and completion of, the Course.
ARTICLE 8 – RESULTS AND LIABILITY
The Course and Website are provided for informational purposes only. You acknowledge and agree that any information posted in the Course, in the Materials, or on the Website is not intended to be legal, tax, or financial advice, and no fiduciary relationship has been created between you and the Seller. You further agree that your participation in the Course is at your own risk.
We do not assume responsibility or liability for any advice or other information given in the Course, in the Materials, or on the Website.
We do not offer any promises or guarantees with regard to our Courses or their Materials. You hereby acknowledge and agree that:
- You are solely and exclusively responsible for the choices that you make with regard to this Course and the Materials contained within it;
- My Bitcoin Academy does not assume any liability regarding the results of any financial or investment decisions you make. Please consult with a certified financial advisor for investment advice if needed.
- This Course does not constitute any financial, legal, or tax advice. My Bitcoin Academy does not provide any such services. Any investment decisions you make are your own responsibility.
ARTICLE 9 – INTELLECTUAL PROPERTY:
You agree that the Materials, the Course, the Website, and any other Services provided by the Seller are the property of the Seller, including all copyrights, trademarks, trade secrets, patents, and other intellectual property (“Company IP”). You agree that the Company owns all rights, titles, and interests in and to the Company IP and that you will not use the Company IP for any unlawful or infringing purpose. You agree not to reproduce or distribute the Company IP in any way, including electronically or via registration of any new trademarks, trade names, service marks, or Uniform Resource Locators (URLs), without express written permission from My Bitcoin Academy.
ARTICLE 10 – SERVICE INTERRUPTIONS:
We may need to interrupt your access to the Course to perform maintenance or emergency services on a scheduled or unscheduled basis. You agree that your access to the Course and/or Website may be affected by unanticipated or unscheduled downtime, for any reason, but that we shall have no liability for any damage or loss caused as a result of such downtime.
ARTICLE 11 – AFFILIATE MARKETING & ADVERTISING
We engage in affiliate marketing whereby we receive a commission on or a percentage of the sale of goods or services on or through the Course and/or Website. We may also accept advertising and sponsorships from commercial businesses or receive other forms of advertising compensation. This disclosure is intended to comply with the US Federal Trade Commission Rules on marketing and advertising, as well as any other legal requirements which may apply.
ARTICLE 12 – REVERSE ENGINEERING & SECURITY
You agree not to undertake any of the following actions:
- Reverse engineer, or attempt to reverse engineer or disassemble any code or software from or on the Course or Website;
- Violate the security of the Course or Website through any unauthorized access, circumvention of encryption or other security tools, data mining or interference to any host, user, or network.
ARTICLE 13 – APPLICABLE LAW
The My Bitcoin Academy Terms are governed by Spanish law.

ARTICLE 14 – MISCELLANEOUS CLAUSES
These Terms constitute the entire agreement between the Customer and My Bitcoin Academy with respect to purchases made through this Website and supersede any prior agreement, written or oral, if any.
The fact that My Bitcoin Academy does not exercise its rights under these Terms does not in any way constitute a waiver or loss of such rights.
